Child Support in Michigan
Michigan uses its own approach. It's called the Michigan Child Support Formula, an income-shares model combining both parents' incomes into one support obligation, then splitting it between them based on their share of the combined income and parenting time. Every Michigan circuit court must use this formula when it sets or changes a support order. Michigan handles this locally. The Michigan Child Support Formula combines both parents' net incomes into a base support obligation. It then adjusts that base amount by how much parenting time each parent has with the child, since more overnights with a parent shifts more of the day-to-day costs onto that household. The formula adds more, too. It covers the child's health care coverage and child care costs. Michigan's State Court Administrative Office publishes the formula manual that circuit courts and Friend of the Court offices use statewide.
Working with the Friend of the Court
Michigan delivers child support services locally, through each circuit court's own Friend of the Court office, which is the parent's main point of contact throughout a case. The Michigan Department of Health and Human Services' Office of Child Support coordinates the program at the state level. Applications go through the local office. So does account access. Families already receiving certain public assistance are generally referred automatically.
Who hears a Michigan child support case
Michigan circuit courts decide child support matters. They apply the Michigan Child Support Formula to each parent's documented income and parenting time, and the local Friend of the Court office investigates the case first and makes a recommendation to the court. It's processed through the state's centralized disbursement system, and it also uses interception of state and federal tax refunds for parents who have fallen significantly behind. License suspension, passport denial, and other administrative remedies are available too. A parent who doesn't comply with a circuit court support order can be brought before the court and held in contempt.
