    Why people choose Virdix

    Someone else delivers the papers

Anyone who is 18 or older and is not part of your case can deliver the papers to your spouse. That could be a friend or family member, a professional process server, or in some counties the sheriff. You cannot deliver them yourself.

    Several ways to deliver

The main ways are handing the papers to your spouse in person, leaving them with someone at your spouse's home or workplace after tries to find them, and mailing them with a form your spouse signs and returns. If your spouse cannot be found, the court can approve publishing or posting a notice.

A proof paper closes the loop

The person who delivered the papers fills in a proof paper that says when, where and how it happened. You file it with the court.

    It keeps your case moving

Your case cannot move forward until the court has proof that your spouse received the papers. The clock for your spouse's response starts from delivery, too.

    Your county's details, organized

Virdix shows you which papers to hand over, what to do after delivery, and where to file the proof in your county.

Common questions about serving divorce papers

Can I hand the divorce papers to my spouse myself?+

No. Someone else has to do it. That person must be 18 or older and must not be part of your case. A friend, a family member, a professional process server, or in some counties the sheriff can all do it.

What are the ways to deliver the papers?+

The main ways are handing them to your spouse in person, leaving them with someone at your spouse's home or workplace when your spouse cannot be found after several tries, and mailing them with a form your spouse signs and sends back. If your spouse truly cannot be found, the court can approve publishing or posting a notice instead.

    What is the proof paper?+

After the papers are delivered, the person who delivered them fills in a signed form describing when, where and how it happened. You file that form with the court. Virdix fills it in with your case details and walks you through what to do next. The form is called FL-115, and FL-117 is the form used for delivery by mail.

Why does the court need proof?+

The court needs to know your spouse was officially told about the case. Your case cannot move forward until that proof is on file.

Does Virdix deliver the papers to my spouse?+

No. Someone who is 18 or older and not part of your case does the delivering. Virdix is self-help software that walks you through the steps and fills in the proof paper from your answers.

What if my spouse is hard to find?+

Tell Virdix what you know and it walks you through the options for your situation. If your spouse cannot be located, the court has to approve publishing or posting a notice before you can use it. A licensed California family law attorney can advise you on your specific case.

Virdix is self-help software, not a law firm, and does not provide legal advice. If your case involves domestic violence or you fear for your safety, call 911 or the National Domestic Violence Hotline at 1-800-799-7233.
