Forms in South Dakota
The Unified Judicial System publishes South Dakota's divorce forms statewide under a "UJS" numbering system, at ujs.sd.gov. The complaint form depends on whether the case involves minor children. For cases without minor children, file UJS-310, Complaint for Divorce without Minor Children, with UJS-309, Summons. For cases with minor children, file UJS-312, Instructions and Form for Divorce Complaint with Minor Children, with UJS-311, Summons. South Dakota also offers a free tool called Guide and File. It asks a series of questions and generates the completed packet, an alternative to filling out the numbered PDF forms by hand. Whether you use Guide and File or download plain PDFs, you end up with the same UJS-numbered documents, recognized by every circuit court in the state.

The complaint, summons, and financial statement
Without minor children, file UJS-310 (Complaint) with UJS-309 (Summons). With minor children, file UJS-312 (Instructions and Form for Divorce Complaint with Minor Children) with UJS-311 (Summons). For stipulated (agreed) divorces, South Dakota requires UJS-023, Instructions for Financial Statement Form, as the financial disclosure document. Both the plaintiff and defendant file it.
UCCJEA and custody jurisdiction
South Dakota's with-children process includes UJS-319B, Affidavit as to Jurisdiction and Grounds for Divorce with Minor Children. It covers the jurisdictional information the Uniform Child Custody Jurisdiction and Enforcement Act requires. Filers submit it alongside UJS-325, Stipulation and Settlement Agreement (covering custody and support terms), and UJS-326B, Judgment and Decree of Divorce, which becomes the final custody order.
Filing: paper for self-represented litigants
Attorneys e-file through South Dakota's statewide File & Serve platform. Self-represented litigants don't go through e-filing as part of the standard process. Both the Guide and File tool and the paper form packets tell filers to print the completed forms and file the originals in person or by mail with the county Clerk of Courts, along with the correct filing fee or an approved fee waiver order.
Fee waiver and self-help network
Filers who cannot afford the filing and service-of-process fees can submit UJS-022, Motion, Affidavit, and Order to Waive Filing Fee & Service of Process Fee.
