Ways to qualify in Florida
- Income. At or below 200% of the federal poverty guidelines for your household size.
- Inability to pay. You explain your income, expenses and debts on a sworn form, and the court decides whether paying the fee would leave you unable to cover basic needs. This route has no income cutoff.
Verified from the statute: you are indigent if income is at or below 200 percent of the current federal poverty guidelines. The CLERK makes the first determination, not a judge, and you can ask the court to review a clerk's denial.
