    Spousal Support in Kentucky

It considers the age and physical and emotional condition of the spouse seeking maintenance.

    No fixed formula or duration

    Kentucky does not tie maintenance to a percentage of income. It also sets no duration schedule based on years of marriage. Some awards run for a fixed period tied to when a spouse is expected to regain employability. Others, especially after long marriages with a large income gap, can run for an extended or indefinite period at the court's discretion.

    Modification and termination

    A court can modify a maintenance order only when changed circumstances are substantial and continuing enough to make the existing terms unconscionable. That is a higher bar than a simple change in circumstances. Kentucky law generally ends maintenance when either party dies or the recipient remarries, unless the decree says otherwise.
